The petitioner is accused in connection with Patahi P.S. Case No. 120 of 2016, registered under Section 395 of the Indian Penal Code and Section 27 of Arms Act. Learned counsel for the petitioner submits that it would appear from the F.I.R. that on the basis of written report of the informant Upendra Sah, Patahi P.S. Case No. 120 of 2016, under Section 395 of the Indian Penal Code and Section 27 of Arms Act was instituted against unknown. In course of investigation, the informant disclosed in his re-statement that he identified two persons namely Amrendra Pandey and Vishal Paswan, who were present at the time of committing dacoity and
Patna High Court Cr.Misc. No.14235 of 2017 (2) dt.08-04-2017 2/2 later on Vishal Paswan in his confessional statement disclosed the name of this petitioner having hand in the present case. Further submission is that petitioner is in custody since 26.12.2016, but he has not been put on T.I.P. while informant has claimed to identify the culprits on seeing them again. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the ACJM, East Champaran in connection with Patahi P.S. Case No. 120 of 2016.
