JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-06-2019 This application, for grant of anticipatory bail, arises out of Jamalpur P.S. Case No. 74/18, disclosing offences under Sections 304(B), 201/34 of the Indian Penal Code. Petitioners happen to be father in law, mother in law and sister in law of the deceased and allegation against them is of causing dowry death of the deceased due to non fulfilment of dowry demand.

Submission of learned counsel for the petitioners is that they are in laws of the deceased and no specific allegation has been attributed to them rather only general and omnibus allegation has been levelled and husband of the deceased is

Heard learned A.P.P. also and perused the report submitted by Forensic Science Laboratory, from which, it appears that no Metallic, Alkaloidal, Gycosidal, Pesticidal and volatile poison could be detected in dark brown fluid as described.

Having heard both sides, considering the facts and circumstances, this application is allowed. Provisional bail earlier granted to the petitioners vide order dated 08.03.2019 is confirmed.
