JUSTICE BIRENDRA KUMAR ORAL ORDER 25-04-2017 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offences punishable under Sections 272/273/34 of the Indian Penal Code and Sections 30(a)/38(i)/41(i) of the Bihar Prohibition and Excise Act, 2016.

Some liquor was recovered from the car and allegation is that petitioners and others have fled away from there. Considering the aforesaid materials, let petitioners, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned 1st Additional Sessions Judge, Darbhanga/Successor Court, in connection with G.O. Excise Case No.62 of 2017, arising out of Biraul P.S. Case

Patna High Court Cr.Misc. No.19401 of 2017 (2) dt.25-04-2017 2/2 No.22 of 2017, with condition that petitioners shall file undertaking at the time of furnishing of the bail-bond before the Court-below that they would not indulge themselves in such activity otherwise the Court below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioners in this case.
