2. The petitioner seeks bail in connection with Sherghati P.S. Case No.-1170 of 2023 registered for the offence under Sections 363 and 366(A) of the Indian Penal Code.

3. As per the prosecution case, it is a case of abduction of the daughter of the informant.

Learned counsel for the petitioner has submitted that petitioner has falsely been implicated in this case. He next submits that there is no eye witness to the alleged occurrence.

Learned APP appearing for the State, opposes the prayer for bail of the petitioner.

On perusal of the first information report, impugned order dated 03.01.2024, it appears that the victim recovered and her statement was recorded by the investigation officer under Section 161 of the Cr.P.C. as also recorded under Section 164 of the Cr.P.C. by the learned Magistrate and she has stated that she voluntarily gone with the petitioner and she has married with the petitioner and petitioner has got clean antecedent as stated in para-3 of the petition, in these circumstances, let the petitioner above named, be directed to be released on bail in connection with Sherghati P.S. Case No.1170 of 2023 on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge POCSO-cumAdditional Sessions Judge VII, Gaya.
