2. The petitioner has prayed for bail in a case registered for the offence punishable under sections 132, 126(2), 127(2), 115(2), 109, 351 (3), 121 (2), 221, 224, 3 (5) of Bharatiya Nyaya Sanhita, 2023.
3. As per allegation in the FIR, petitioner along with two other co-accused persons has created hindrance to the police officials in discharging their official duty. Specific allegation against the petitioner is that he assaulted the police by fists and slaps as a result of which blood started oozing out and accused persons also tried to snatch their pistol. Thereupon police force came there and petitioner was arrested on spot

4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. General and omnibus allegations have been levelled against him. He was only a member of the mob. After completion of investigation, chargesheet has been submitted. Petitioner is languishing in judicial custody since 18.10.2024.
5. The application for bail is opposed by learned APP for the State.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail after framing of charge. The above named petitioner is directed to be enlarged on bail after framing of charge on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class-cum-Additional Munsif, Samastipur in connection with Khanpur P.S. Case No. 235 of 2024 with following conditions;
(i) One of the bailors should be close relative of the petitioner.
Patna High Court CR. MISC. No.10344 of 2025(3) dt.09-05-2025 3/3 (ii) Petitioner shall co-operate in the trial and shall be present on each and every fixed date and on his absence on two consecutive dates without sufficient reason, his bail bonds may be cancelled by the learned trial Court.
