The petitioners seek regular bail in connection with G.O. Excise Case No. 112 of 2016, arising out of Bahera P.S. Case No. 335 of 2016, registered for offences punishable under Sections 30(a) and 37(b) of the Bihar Prohibition and Excise Act, 2016.
The allegation, in brief, is that the accused persons were found traveling in a Duster vehicle and on road the police stopped the vehicle and on search from the dickey of the vehicle 24 bottles of foreign liquor being carried by the accused persons, was recovered. It is said that they used to supply it to the
Patna High Court Cr.Misc. No.11253 of 2017 (4) dt.10-05-2017 2/2 hotel owners.
Learned counsel appearing on behalf of the petitioners submits that co-accused Sujit Kumar Jha @ Sujit Kumar and Mojibul Rahman have been granted bail by this Court and another co-accused Sushant Mishra @ Sushant Kumar Mishra @ Bam Babu has been granted bail by a co-ordinate Bench of this Court. The cases of the petitioners stand on similar footing. Besides this, they have no any criminal antecedent and they are in custody since 14.12.2016. The charge sheet has been submitted in this case.
Considering the facts as stated above, let the petitioners, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Sessions Judge-Special Judge, Darbhanga, Bihar in connection with G.O. Excise Case No. 112 of 2016 (arising out of Bahera P.S. Case No. 335 of 2016).
