JUSTICE JYOTI SARAN ORAL ORDER 29-03-2016 Heard Mr. Bashistha Narain Mishra, learned counsel appearing for the petitioner and learned counsel for the State. The petitioner apprehends his arrest in connection with Srinagar Pujahan P.S. Case No.95 of 2015 for the offences punishable under sections 457, 380 and 511/34 of the Indian Penal Code.
It is a peculiar case in which the petitioner allegedly being apprehended by the informant and handed over to the police was yet not arrested, rather admitted in M.J.K. Hospital where a second FIR was instituted against the informant of the present case for assaulting this petitioner.
In the circumstances so discussed above, let the petitioner, namely, Naushad Alam in the event of his arrest or surrender within four weeks from today be released on bail on
Patna High Court Cr.Misc. No.5140 of 2016 (2) dt.29-03-2016 furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Shri S.M. Afzal, Judicial Magistrate 1st Class, Bettiah, district- West Champaran and/or the court concerned in connection with Srinagar Pujahan P.S. Case No.95 of 2015 subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
