JUSTICE SANJAY PRIYA ORAL ORDER 20-04-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Madhubani Town P.S. Case No. 352 of 2016 instituted for the offence under Sections272, 273 of the Indian Penal Code and Sections-30(a), 36, 41 of Bihar Excise Prohibition Amendment Act, 2016. From the written report, it appears that foreign liquor has been recovered from Maximo vehicle as mentioned in the written report. The driver of the aforesaid vehicle disclosed the name of this petitioner.

From the written report itself, it appears that there is no recovery of any foreign liquor from possession of this petitioner. The petitioner is in jail custody since 23-12-2016. In such circumstances, the prayer for bail is allowed

Patna High Court Cr.Misc. No.8813 of 2017 (3) dt.20-04-2017 2/2 and the petitioner named above, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Madhubani Town P.S. Case No. 352 of 2016 to the satisfaction of learned Chief Judicial Magistrate, Madhubani subject to condition that both the bailors should be close relatives of the petitioner.
