JUSTICE SANJAY KUMAR ORAL ORDER 07-02-2017 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.

The petitioner seeks regular bail in connection with Baikunthpur P.S. Case No. 171 of 2016 registered for the offences punishable under Sections 272, 273, 420 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

The allegation is that 30 litres illicit country made liquor kept in a gallon besides, few pouches and one bottle were recovered from behind the house of the petitioner hidden under thatch.

Learned counsel for the petitioner submits that the petitioner was neither arrested from the place of occurrence nor seizure list bears the signature of any family members of this

Patna High Court Cr.Misc. No.5572 of 2017 (2) dt.07-02-2017 2/2 petitioner and the seizure list witnesses are the members of the raiding party. Learned counsel for the petitioner further submits that the petitioner is in custody since 04.01.2017, having no criminal antecedent.

Considering the period of custody of the petitioner as well as facts and circumstances stated above, let the petitioner be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the each amount to the satisfaction of the learned Additional Chief Judicial Magistrate - III, Gopalganj in connection with Baikunthpur P.S. Case No. 171 of 2016.
