2. The petitioner apprehends his arrest in a case registered for the offence under Section 274, 275 of B.N.S., 2023 and Section 30(a) of Bihar Prohibition and Excise Act.

3. As per F.I.R., 42 liters of illicit Nepali wine has been recovered from behind the house of this petitioner.

4. It is submitted on behalf of petitioner that no incriminating article has been recovered from the conscious possession of petitioner. Recovery has been made from open place. Petitioner claims clean antecedent.

5. Learned A.P.P. for the State has opposed the bail petition.

6. Considering the nature of accusation and clean antecedent, let the above named petitioner, in the event of

No.10592 of 2025(2) dt.07-03-2025 2/2 arrest/surrender within a period of eight weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Addl. District & Sessions Judge II-cumSpecial Judge, Excise Act, Madhubani in connection with Ladania P.S. Case No. 434 of 2024, subject to condition as laid down under Section 482 of the B.N.S.S., 2023.
