JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 08-07-2019 Learned counsel for the petitioner, with petitioner, and learned counsel for opposite party no. 2 are present. Learned counsel for opposite party no. 2 submits that due to rain, opposite party no. 2 could not come to Court. The accusation is of torturing of complainant/opposite party no. 2 due to non-fulfillment of demand of Rs. 2,00,000/- and removing her with a minor son from matrimonial house. Later on she gave birth to a girl child at her naiher. Learned counsel for the petitioner submits that in fact he wants to keep his wife, opposite party no. 2, with full dignity and he has made attempt, in this regard, by filing Matrimonial Suit No. 28 of 2017 under Section 9 of the Hindu Marriage Act
Patna High Court CR. MISC. No.10424 of 2019(5) dt.08-07-2019 2/2 on 28.02.2017 against his wife, opposite party no. 2, in which she appeared, but, opposite party no. 2 is not willing to restitute conjugal life.
The petitioner has been granted provisional pre-arrest bail vide order, dated 21.02.2019.
