Petitioner seeks bail in connection Itarhi P.S. Case no. 212 of 2020 registered for the offence punishable under sections 379, 413, 414 of the Indian Penal Code.
Learned counsel for the petitioner submits that from bare perusal of the allegation as alleged in the FIR, it would manifest that the informant alleged that a tip off was received that some persons coming to sell a stolen Mahendra Bhumiputra tractor and when the police reached the place four persons fled away on seeing the police. It is further alleged that two persons were apprehended who disclosed the names of their associates. Thereafter, it is alleged that one motorcycle and one mobile phone were recovered from the possession of the persons who

Learned counsel for the petitioner further submits that the persons who were apprehended disclosed the name of this petitioner and they have been granted regular bail by this court vide order dated 25.6.2021 in Cr. Misc. no. 7341/2021 (Rahul Bhar @ Rahul Kumar Bhar vs. State of Bihar) and order dated 21.5.2021 in Cr. Misc. no. 10537/2021 (Aashish Chauhan vs. State of Bihar). Further, petitioner is in custody since 02.12.2020 and charge sheet has been submitted.
Learned APP vehemently opposed the prayer for bail. Considering the facts that petitioner is in jail custody since 02.12.2020, charge sheet has been submitted and the persons who disclosed the name of the petitioner have been granted bail recorded aforesaid, the petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Addl. Chief Judicial Magistrate IV, Buxar in Itarhi P.S. Case no. 212 of 2020.
