The petitioner seeks bail in connection with Roshanganj P.S. Case No.30 of 2016/POCSO Case No.12 of 2016 registered under Sections 354(A)/34 of the Indian Penal Code besides Section 12 of the P.O.C.S.O. Act, 2012.
The accusation is that on 27.02.2016 at about 03.00 P.M., when the informant was going to throw the garbage then Azad Bhiyan, this petitioner and Birendra Bhuiyan stopped the informant and asked her to come as per their direction otherwise they would kill her and her brother. At that time, Arun Bhuiyan was going in that way and heard their conversation. When the
Patna High Court Cr.Misc. No.8177 of 2017 (2) dt.10-03-2017 2/2 informant came to her house, she narrated about the same to her mother and family members. Thereafter, while the panchayati was arranged but the petitioner refused to obey the decision of the Panchayati.
Learned counsel appearing on behalf of the petitioner submits that the petitioner has falsely been implicated in this case with an ulterior motive and he having no criminal antecedent is in custody since 21.06.2016.
Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the 1st Additional Sessions Judge-cum-Special Judge, POCSO, Gaya, in connection with Roshanganj P.S. Case No.30 of 2016/POCSO Case No.12 of 2016.
