The petitioners apprehend their arrest in Complaint Case No. 970C of 2013, registered for the offences punishable under Sections 420 and 120B of the Indian Penal Code. The complainant alleged that he had purchased the land on 13.08.2001, but the accused nos. 3, 4 and 5 Sonelal Yadav, Asharfi Yadav and Raj Kishore Yadav with the help of Umesh Yadav and Anil Mahto purchased the land from Raghunandan Yadav.

Learned counsel for the petitioners submits that accused nos. 3, 4 and 5 Sonelal Yadav, Asharfi Yadav and Raj Kishore

Patna High Court Cr.Misc. No.5808 of 2015 (2) dt.11-02-2015 2/2 Yadav sold the same lands in favour of the complainant in the year 2001 and he again executed the sale deed with regard to remaining lands of their share in favour of Raghunandan Yadav. The dispute is of civil nature.

Considering the facts that the case of the vendors is that they had much lands in the same Khesra, therefore, they executed the sale deed in favour of Raghunandan Yadav with regard to remaining land, the petitioners, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Khagaria in connection with Complaint Case No. 970C of 2013, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
