This is an application for grant of regular bail filed on behalf of the petitioner. Petitioner is in custody in connection with Basantpur PS Case No. 376 of 2018 for the alleged offence punishable under Sections 399, 402, 413, 414, 420 and 120(B) of the Indian Penal Code and Sections 25(1-b)a, 26 and 35 of the Arms Act.

Allegation is that in the instant case one country made pistol with live cartridge was recovered from the possession of the petitioner. Learned counsel for the petitioner submits that petitioner has no connection with the seized articles. He further submits that petitioner has no criminal antecedent and he is in custody since 01.11.2019.

Patna High Court CR. MISC. No.12115 of 2019(2) dt.27-02-2019 2/2 Considering the fact that the petitioner has no criminal antecedent and has remained in custody since 01.11.2019, this application is allowed.

Accordingly, let the petitioner above named, be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Siwan in connection with Basantpur PS Case No. 376 of 2018.
