The petitioner seeks bail in Madhubani Town P.S. case No. 390 of 2016 under Section 414/34 of the Indian Penal Code.

The informant alleged that he got information that one Md. Ful Hasan was going towards air port on a stolen Passion Pro motor cycle. On such information, Md. Ful Hasan was apprehended and he disclosed the name of the petitioner, Md. Minhaj. The petitioner was also apprehended and on his disclosure one stolen motor cycle was recovered from the house of another accused.

The learned counsel for the petitioner submits that

Patna High Court Cr.Misc. No.12388 of 2017 (3) dt.11-04-2017 2/2 nothing has been recovered from the possession of the petitioner. The petitioner has got no criminal antecedent and he is in jail since 16.11.2016. The petitioner has remained in jail for about five months.

Considering the facts aforesaid and the fact that petitioner has got no criminal antecedent and he is in jail for about five months, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Madhubani in Madhubani Town P.S. Case No. 390 of 2016.
