24-09-2018 The Authorized Officer-cum-Divisional Forest Officer, Rohtas, Sasaram is directed to consider the provisional release petition of the petitioner, a copy of which has been brought on record by Annexure-3 to the present application. Learned counsel for the petitioner informs this court that the provisional release petition is pending since 13.12.2017.
In that view of the matter, the Authorized Officer-cum-Divisional Forest Officer, Rohtas at Sasaram shall ensure that the application of the petitioner must be heard and disposed of within a
Patna High Court Cr. WJC No.646 of 2018 (2) dt.24-09-2018 period of days from the date of receipt/production of a copy of this order. Let it be recorded that because of pendency of such application the court is being burdened in its extraordinary writ jurisdiction with this kind of release matters. The Authorized officer cum Divisional Forest Officer, Rohtas at Sasaram is therefore required to consider such applications within a reasonable time failing which this court may, in appropriate case, be constrained to impose cost against the authorities.
This application stands disposed off with the aforesaid direction.
