This is an application for bail in connection with Panapur P.S.Case No. 83 of 2016 registered for the offences punishable under Sections 147, 148, 149, 341, 323 and 302 of the Indian Penal Code.

Allegation against the petitioner is that he caught hold of the leg of the deceased and other accused persons also caught hold of the deceased and one Sonu Rai gave farsa blow on the head of the deceased and thereafter he was taken to hospital and on way he succumbed to the injury.

It has been submitted on behalf of the petitioner that there is no allegation of assault against the petitioner, rather it is alleged that he caught hold of the leg of the deceased and he is in

Patna High Court Cr.Misc. No.16911 of 2017 (2) dt.13-04-2017 2/2 custody since 30.7.2016 and now charge is likely to be framed on next date, i.e., 18.4.2017.

Heard learned APP also, who has opposed the prayer for bail.

Having heard both sides and in view of the allegation and charge-sheet has already been submitted in this case, I am not inclined to grant bail to the petitioner at this stage. However, learned trial court is directed to expedite the trial.

Accordingly, this application is dismissed.
