The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 304B, 201/34 of the Indian Penal Code.

According to prosecution story, the informant alleged that the petitioner along with other co-accused persons used to torture and assault the informant's daughter due to nonfulfillment of dowry demand. Further, on 1.6.2022 the informant came to know that the accused persons killed his daughter. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case. There is no prior complaint regarding misbehave or torture the deceased by the petitioner. The petitioner is husband of the deceased and he solemnized

Patna High Court CR. MISC. No.11083 of 2023(3) dt.04-07-2023 2/2 love marriage with the deceased, thus he never demanded dowry from her. During course of investigation, witnesses stated that petitioner went to Delhi for livelihood and he did not take the deceased with him due to which she committed suicide. It is further submitted that the charge-sheet has been submitted u/s 306 of the I.P.C. It is further submitted that the petitioner has got no criminal antecedent and languishing in judicial custody since 23.9.2022.

Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody of the petitioner, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Singheshwar P.S. Case No. 133 of 2022 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Madhepura.
