The present application under Section 482 of the Code of Criminal Procedure, 1973 seeks quashing of the order dated 11.12.2012 passed by the learned Chief Judicial Magistrate, Madhubani in T.R. No. 3076 of 2013 arising out of Babubarhi P.S. Case No. 132 of 2011, by which cognizance has been taken under Sections 341/323/504/506/436 of the Indian Penal Code as well as Section 3(1)(v)(x)(xv) and 3(2)(iii)(iv)(v) of The Scheduled Castes and Schedules Tribes
Patna High Court Cr.Misc. No.14917 of 2013 (4) dt.16-07-2015 2/2 (Prevention of Atrocities) Act, 1989 and the petitioners have been summoned.
After some argument, learned counsel for the petitioners seeks permission to withdraw the application with a liberty that the points available to him in support of his defence shall be placed before the Court at the time of framing of the charge.
