This application is for grant of bail in connection with Buxar Rail P.S.Case No.103 of 2016 for the offence under Sections 414 and 147 of the Indian Penal Code. It is submitted on behalf of the petitioner that he is in custody for about six months and allegation is false. The petitioner has criminal antecedent and he has been apprehended. One Laptop has been recovered from the possession of the petitioner Heard learned A.P.P. also.

Having heard both sides and in view of allegation coupled with criminal antecedent, I am not inclined to grant bail to the petitioner at this stage, however, as the petitioner has remained in custody for about six months, the learned trial court is directed to

Patna High Court Cr.Misc. No.13652 of 2017 (2) dt.23-03-2017 2/2 expedite the trial and try to conclude it within a period of six months and if not concluded, the petitioner is at liberty to move the court concerned itself, which will be considered by the learned court below on the basis of materials available at that time. With the aforesaid observation, this application is dismissed.
