JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 05-04-2021 Rule 5(Kha) of Bihar Rajkriyakrit Prarambhik Vidyalaya Sikshak Sthanantaran, Anushashanik Karyawahi Avem Pronatti Niyamawali, 2018 enables teachers governed by the said Rules to seek transfer. Otherwise the post of teachers governed by the said Rules is not transferable. It is the petitioner's case that she has applied for her transfer before the District Magistrate, Gaya through letter dated 22.12.2020 which is still pending for final decision.

In the said background, the petitioner is seeking

Patna High Court CWJC No.6806 of 2021(2) dt.05-04-2021 2/2 direction to the respondents to consider her case for transfer to either of the places as mentioned in her representation, which has been brought on record by way of Annexure 3 to the writ application.

Considering the nature of relief which the petitioner is seeking, this application is disposed of with a direction that let the petitioner's representation for her transfer be considered in accordance with the Rules noted above and the decision be taken within two months from the date of receipt/production of a copy of this order.

The petitioner shall be at liberty to enclose a fresh copy of her representation which has been brought on record by way of Annexure 3 to the writ application along with the present order before the competent authority.
