JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 24-07-2017 By order dated, 04.12.2014, passed by the learned Principal Judge, Family Court, Jamui, maintenance allowance, @ Rs. 2,000/- per month, has been allowed in favour of the opposite party, to be paid by the petitioner, who is admittedly her husband.
2. Learned counsel, appearing on behalf of the petitioner, has submitted that the petitioner is a lowly paid daily wager. He contends that the petitioner may not be able to pay
Patna High Court CR. REV. No.137 of 2015(3) dt.24-07-2017 2/2 large amount of Rs. 2,000/-, considering his low income.
3. I have perused the impugned order, dated 04.12.2014. The petitioner is admittedly young man, hale and hearty. The amount of Rs. 2,000/- is a meager amount, which cannot be said to be excessive these days.
4. Learned counsel, appearing on behalf of the petitioner, has submitted that the petitioner has been paying a sum of Rs. 500/- per month as maintenance allowance, in terms of this Court's order passed on an anticipatory bail petition filed on behalf of the petitioner.
5. Needless to say that the amount of Rs. 500/- shall be adjustable against the said amount of Rs. 2,000/-, which has been determined by the Court of Principal Judge, Family Court, Jamui.
6. I do not find any merit in this application. This application is, accordingly, dismissed.
