ANJANA MISHRA ORAL ORDER 25-02-2016 Heard learned counsel for the petitioners and the learned counsel appearing on behalf of the State. Petitioner Nos.1 and 2, being the Dewars and Petitioner Nos.3 and 4, being the Nanads of the deceased lady, are apprehending their arrest in connection with Runnisaidpur P.S. Case No.500 of 2015 for allegedly having committed the offence under Sections 304B and 201/34 of the Indian Penal Code.

Learned counsel for the petitioners submits that there is general and omnibus allegation against these petitioners and actually, the deceased died after giving birth to a female child due to post-delivery complications. It is submitted that she was

Patna High Court Cr.Misc. No.5026 of 2016 (2) dt.25-02-2016 2/2 suffering from severe anemia, which stands recorded in the medical report. It is further submitted that considering the aforementioned facts and circumstances, father-in-law and the mother-in-law of the deceased, namely, Rameshwar Mahto @ Parmeswar Mahto and Sirpati Devi, have been extended the privilege of anticipatory bail by a Bench of this Court in Cr.Misc. No.7401 of 2016, vide order dated 19.02.2016.

Considering the aforementioned facts and circumstances and that save and except the bald allegation against these petitioners, there is no other further material, let all the petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sitamarhi, in connection with Runnisaidpur P.S. Case No.500 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
