JUSTICE VINOD KUMAR SINHA ORAL ORDER 27-02-2019 Petitioner seeks bail in anticipation of his arrest in connection with Dhamdaha P.S. Case No. 227 of 2017 registered for the offences punishable under Sections 323, 341, 504 and 379/34 of the Indian Penal Code but cognizance has been taken under Sections 341, 323, 504, 392 and 34 IPC. Allegation against the petitioner is of snatching Rs.40,000/- from the informant.

Submission of learned counsel for the petitioner is that petitioner has clean antecedent and police after investigation has found the case not true against the petitioner but cognizance has been taken.

Heard learned APP also.

Having heard both sides and in the facts and circumstances, let petitioner, above named, in the event of arrest

Patna High Court CR. MISC. No.11904 of 2019(2) dt.27-02-2019 2/2 or surrender within a period of six weeks from the receipt of this order, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Purnia, in connection with Dhamdaha P.S. Case No. 225 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further condition that one of the bailors of the petitioner shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
