The petitioner seeks bail in a case instituted for the offences under Sections 302, 201, 120(b) of the Indian Penal Code.
The prosecution case in short is that the accused persons committed murder of the husband of the informant while he was sleeping at his house.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 20.8.2019 and has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. Charge-sheet has been submitted in the present case. The informant is not an eye witness to the alleged occurrence. There is no blood stain found
Patna High Court CR. MISC. No.11479 of 2020(2) dt.28-02-2020 2/2 at the place of occurrence. Merely on the basis of suspicion, the name of the petitioner has transpired in the present case. Except for suspicion, there is no other substantive evidence to suggest his implication in the present case. There is no direct or indirect evidence to suggest the participation of the petitioner in the present case. The dead body is alleged to have been recovered from the canal which is 10 kms. away from the house of the petitioner.
On behalf of the State, it is submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, it is directed that the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jehanabad in connection with Shakurabad P.S. Case No. 119/2019.
