1. Heard learned counsel for the parties.
2. The petitioner has preferred this application for grant of regular bail in connection with Sitamarhi P.S. Case no.396 and 2023 registered under section 392 of the Indian Penal Code.
3. As per the prosecution case, the informant states that two accused persons on a motorcycle, on the point of pistol, looted the informant of a bag containing cash to the tune of Rs.1,03,810/- besides other articles as mentioned in the FIR.
4. Learned counsel for the petitioner submits that the FIR was registered against unknown. Referring to the order of the learned trial Court it is submitted that the prosecution is mainly relying on the confessional statement of this petitioner as also that of co-accused Kanhaiya Kumar Yadav made before
Patna High Court CR. MISC. No.13522 of 2024(2) dt.12-03-2024 2/2 police. The reason of false implication of the petitioner is his antecedents. He is in custody since 3.11.2023.
5. The application for bail is opposed by learned APP for the State.
6. Having heard learned counsel for the parties and taking into consideration the allegations in the FIR, the contents of the order of the learned trial Court, grant of bail to coaccused Kanhaiya Kumar Yadav vide order dated 22.2.2024 passed in Cr. Misc. no.11261 of 2024 together with the petitioner having remained in custody for 4 months since 3.11.2023, the petitioner is directed to be enlarged on bail in connection with Sitamarhi P.S. Case no.396 and 2023 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sitamarhi.
