JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 19-04-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in connection with Jagdishpur P.S. Case No. 82 of 2016, registered under Sections 406 and 420 of the Indian Penal Code.

The accusation is that informant, being the supervisor of Shaguna Foods Pvt. Ltd. who used to do the business of poultry form, executed the agreement with the petitioner and accordingly 4555 pieces of chicken, 192 bags of chicken food, each containing 60 Kg and medicines were given to the petitioner and according to the agreement the petitioner had to return chicken to the company after 39 days. On 21.01.2016, when informant reached at the house of petitioner for receiving the chicken then petitioner was not found in his house and

Patna High Court Cr.Misc. No.11799 of 2017 (2) dt.19-04-2017 2/2 informant came to know that petitioner left the house after selling all the chicken and, therefore, the petitioner misappropriated Rs. 4,08,312/-.

Learned counsel for the petitioner submits that it would appear from the F.I.R. that the dispute appears to be noncompliance of the agreement in between the petitioner and the informant. The petitioner having no criminal antecedent is in custody since 16.01.2017.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Addl. Chief Judicial Magistrate-XI, Bhojpur, Ara in connection with Jagidhspur P.S. Case No.82 of 2016. (Rajendra Kumar Mishra, J) manish/- U T
