Heard learned counsel for the petitioner and learned counsel for the State.
The petitioner apprehends her arrest in Pipariya P.S. Case No. 45 of 2018, registered for the offences punishable under Sections 498A, 304B, 201 and 34 of the Indian Penal Code and section 3/4 of the Dowry Prohibition Act. The informant alleged that his daughter was married with Sikendra Kumar on 26.04.2018 and his daughter was being tortured by Sikendra Kumar (husband) as he has illicit relation with his Bhabhi and he also used to demand Rs. 3 lakh. Ultimately, on 26.09.2018, the informant got information that
Patna High Court CR. MISC. No.13215 of 2020(2) dt.30-09-2020 2/2 the accused persons killed his daughter.
It is submitted that petitioner has been falsely implicated in this case. Petitioner is mother-in-law of the deceased. Petitioner is living separately and she has nothing to do with the family affair of the deceased and her husband. There is general and omnibus allegation against her. Petitioner is having clean antecedent.
Considering the facts aforesaid, the petitioner abovenamed, in the event of her arrest/surrender before the court below within a period of eight weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Lakhisarai in connection with Pipariya P.S. Case No. 45 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
