In this case, the petitioner is seeking anticipatory bail in connection with Desari P.S. Case No.347 of 2019, registered for the offence punishable under Section 30 (a) of Bihar Prohibition & Excise Act.

The police has recovered 100 liters of illicit liquor from the house of co-accused Meena Devi, however, counsel for the petitioner submits that the said co-accused Meena Devi has already been granted anticipatory bail by a coordinate Bench of this Court vide order dated 21.01.2020 passed in Cr. Misc. No.3604 of 20290. It is urged that the petitioner is a lady having no criminal antecedent.

No.12306 of 2020(2) dt.21-07-2020 2/2 Looking to the entire facts and circumstances of the case, let the petitioner, above-named, be released on anticipatory bail in the event of her arrest or surrender before the learned Court below within a period of eight weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-II-cum-Special Judge, Excise, Vaishali at Hajipur in connection with Desari P.S. Case no.347 of 2019, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure with a further condition that if the petitioner, after her release in this case, is again found involved in similar nature of cases then the concerned court would be at liberty to take steps for cancellation of her bail bonds.
