JUSTICE DINESH KUMAR SINGH ORAL ORDER 09-02-2016 Heard learned counsels for the petitioner and the State. The petitioner being the elder brother of the husband of the informant is apprehending arrest in a case registered for the offences punishable under Section 498A of the Indian Penal Code and 3/4 of the Dowry Prohibition Act.

Basic accusation is of torture for non-fulfillment of dowry demand.

It is submitted by learned counsel for the petitioner that the accusation is not specific against the petitioner. In fact, the petitioner gave rupees one lack to the brother of the informant and out of the said amount only rupees forty nine thousand was returned but rest of the amount was not returned for which Complaint Case No. 964-C/2013 was filed on 20.08.2008. Considering the complaint case lodged by the petitioner

Patna High Court Cr.Misc. No.6460 of 2016 (2) dt.09-02-2016 2/2 at earlier point of time, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned SDJM, Bagaha, West Champaran in connection with Bagaha (Mahila) P.S. Case No.65/2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
