JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 26-02-2019 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Samho P.S. Case No. 50 of 2018 for the offence under Sections 25(1-b) a, 26 of the Arms Act.

Learned counsel for the petitioner submits that in the instant case one country made pistol with live cartridge was seized. He further submits that the petitioner has got no criminal antecedent and in fact nothing was recovered from his conscious possession. He submits that the seizure list was not prepared as per the mandatory provision prescribed under Section 100 of the Cr.P.C. The petitioner is in custody since 28.11.2018. Considering the fact that the petitioner has got no criminal antecedent and the investigation of the case is now complete, the petitioner, named above, is directed to be released
