2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 409, 420, 379, 353 , 120(B) of the Indian Penal Code .
3. As per the prosecution case , petitioner is custodian of the missing documents in question and till now
Patna High Court CR. MISC. No.15671 of 2024(7) dt.24-06-2024 2/3 he has failed to produce those documents, due to which payment of several contractors could not be processed.
4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case . As a matter of fact, petitioner has given entire measurement books to Pankaj Kumar, Lower Divisional Clerk in the light of office order No. 60dated 18.09.2023, Memo No. 1904 dated 18.09.2023 issued by Executive Engineer, PHED, Kishanganj. He further submits that during pendency of the case , a departmental proceeding has already been initiated against the petitioner and he has been suspended on 06.06.2024 . Petitioner claims clean antecedent.
5. Learned counsel for the State as well as Opposite party No. 2 oppose the bail petition of the petitioner.
6. Considering the fact that petitioner has already been suspended and other circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate , Kishanganj in connection with Kishanganj P.S. case No. 524 of 2023 ,
