ANJANA MISHRA ORAL ORDER 09-05-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner apprehends his arrest in connection with a case registered for the offences punishable under Sections 147/ 148/149/427/302/379 of the Indian Penal Code, Section 27 of the Arms Act, 3⁄4 of the Explosive Substance Act and Section 17 of the C.L.A. Act.

Learned counsel for the petitioner submits that the petitioner is not named in the First Information Report but subsequently on the statement made before the Police by a co-accused Shiv Chandra Mahto, the petitioner's name has been dragged into the present case. It is further submitted that the allegation is against several unknown persons. Similarly situated co-accused, namely,

Patna High Court Cr.Misc. No.5049 of 2016 (3) dt.09-05-2016 P2/2 Manish Sahni whose name has also figured in the confessional statement has since been extended the privilege of anticipatory bail by a Bench of this Court in Cr. Misc. No. 44226 of 2013 vide order dated 23.10.2013.

Considering the aforementioned facts and circumstances and the fact that the petitioner is having no criminal antecedent, let the petitioner, in the event of his arrest / surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Patepur P.S. Case No. 139/2012, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
