2. Petitioner seeks regular bail in connection with G.B Nagar P. S. Case No. 476/2024 in a case registered for the offences punishable under Sections 316(5), 318(4) of the Bharatiya Nyaya Sanhita.

As per prosecution case, the then Branch Manager of Punjab National Bank, Dindayalpur Branch, Siwan, namely, Kundan Kumar Singh defalcated amount of Rs. 37,25,637/- of the pensioners who were already dead by using their forged life certificate, at different places where he was posted. It is further alleged that this petitioner was also involved in the said offence.

4. Learned counsel for the petitioner submits that petitioner is not named in the F.I.R. Name of the petitioner transpired during course of investigation. The pension amount deposited in the account of dead persons cannot be withdrawn or transferred by petitioner as he has no access to those accounts. Petitioner is not an employee of the PNB bank as such, he did not have access to any documents or software of the bank, thus, petitioner cannot be said to have played any role in the alleged defalcation. The only material that has come against petitioner is that he was instrumental in fraudulently transferring money into the accounts of Md. Mustafa and Sharda Devi. Petitioner claims clean antecedent and is in custody since 27.12.2024. Charge-sheet has already been submitted.

5. Learned A.P.P. for the State as well as learned counsel for the O.P. No. 2 vehemently opposed the bail application.

6. Considering the aforesaid facts and circumstances of the case and period of custody, the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-IV, Siwan in connection with G.B. Nagar Colony P.
