2. This application has been filed on behalf of the petitioner for the following reliefs:- (i) For issuance of an appropriate writ for commanding the respondents to release the property of the petitioner.

(ii) For issuance of an appropriate writ directing the Respondents to pay compensation of the damages occurred in a proceeding under sections 82 and 83 of the Code of Criminal Procedure in which the petitioner has neither been named nor the property in question belongs to any

3. The ACJM-1, Bhagalpur is directed to consider the application of the petitioner dated 10.12.2022 within 15 days and pass a reasoned order in the case.

4. If he finds that the son of the petitioner, who is an accused and is already behind bars, the household goods etc. which have been seized pursuant to the execution of the process issued under Section 83 of the Cr.P.C. shall be released forthwith.

5. With the aforesaid direction, this application is disposed of.

6. Let a copy of this order be communicated to the Principal District and Sessions Judge, Bhagalpur through FAX for its compliance.
