The petitioner is languishing in custody since 29.11.2018 in a case registered for the offences punishable under Sections 420,467,468,471 and 414/120B of the I.P.C.

The prosecution case is that the informant received a secret information that some miscreants standing near Axis Bank ATM are preparing to commit crime, the informant after constituting a raiding team, reached there but on seeing the police party, the miscreants started fleeing when six persons including the petitioner were apprehended. From the possession of the petitioner, one laptop, two mobile phones and four ATM Cards were recovered.

It is submitted by learned counsel for the petitioner that there is no accusation of misusing the recovered ATM Cards.

Patna High Court Cr.Misc. No.11028 of 2019(2) dt.25-02-2019 2/2 Statement has been made in paragraph 3 of the petition that the petitioner is not having any criminal antecedent. It is further submitted that similarly situated co-accused Manish Kumar has been granted bail vide order dated 19.2.2019 passed in Cr. Misc. No.9928 of 2019 by a co-ordinate Bench of this Court. Considering the fact similarly situated co-accused has been granted bail, statement being made in paragraph 3 of the petition that the petitioner is not having any criminal antecedent and the period under custody, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Nawada in connection with Hisua P.S.
