Petitioners are apprehending their arrest in a complaint case wherein processes were directed to be issued after cognizance being taken for the offences punishable under Sections 147, 323, 380, 395, 397 of the Indian Penal Code. The accusation is of making assault to the complainant and taking away articles from the house. It is submitted by learned counsel for the petitioners that for the occurrence of 23.06.2012 the complaint was filed on 16.01.2013, whereas on earlier point of time, for the same incidence Chhatapur P.S. Case No. 210 of 2012 was lodged on 02.07.2012, wherein the police submitted final form finding the accusation false against the petitioners. It is
Patna High Court Cr.Misc. No.35973 of 2015 (2) dt.21-08-2015 2/2 further submitted that petitioner No. 1 is the own brother of the informant and petitioners' side has filed a case at earlier point of time.
Considering the aforesaid facts, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Supaul in connection with Complaint Case No. 166C of 2013, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
