The petitioner apprehends his arrest in Banmankhi P.S. Case No. 62 of 2021, registered for the offences punishable under Sections 302/34 of the Indian Penal Code. As per the prosecution case, due to land dispute this petitioner with the help of others killed the father of informant. It is submitted that due to enmity this petitioner has been made accused in this case. Informant is not eye-witness of the occurrence and only after recovery of dead body of informant's father the present case has been lodged. During course of investigation, no material has come against this petitioner which show his complicity in the alleged occurrence. However, counsel for State vehemently opposed the

Patna High Court CR. MISC. No.11504 of 2022(2) dt.11-08-2022 2/2 prayer for bail and submitted that petitioner is named in the FIR and there is specific allegation that this petitioner with the help of others killed the father of informant.

Considering the facts aforesaid and gravity of offence, I am not inclined to enlarge the petitioner above-named on anticipatory bail.

Accordingly, the prayer for anticipatory bail is rejected.
