05-03-2020 Heard learned counsel for the parties.
The petitioners apprehend their arrest in Sonepur P.S. Case No. 659 of 2019 registered for the offence under Section 366 of the Indian Penal Code.
In the F.I.R., the informant has made allegation against the petitioners of kidnapping his wife. It is submitted on behalf of petitioners that petitioners have falsely been implicated in this case. It is further submitted that wife of the informant has already been recovered
Patna High Court CR. MISC. No.13456 of 2020(2) dt.05-03-2020 2/2 from Saran Railway Station and thereafter, her statement was recorded under Section 164 of the Cr.P.C., in which, she has denied the allegation of kidnapping. The victim lady has stated that she had left her matrimonial house on her own will, since she is in love with petitioner no. 1 and she also wants to marry him. Petitioners are having no criminal antecedent. Considering the aforesaid facts and circumstances as well as statement of the wife of informant recorded under Section 164 of the Cr.P.C., in the event of their arrest/surrender within a period of six weeks from today, let the above named petitioners be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saran at Chapra in connection with Sonepur P.S. Case No. 659 of 2019, subject to condition, as laid down under Section 438(2) of the Cr.P.C.
