Petitioner apprehends arrest in a case registered for the offence punishable under sections 323, 341, 406, 506/34 of the Indian Penal Code.

It is alleged that all the accused including this petitioner cheated the complainant and other people of his village and took money, on the pretext of giving them loan. Thus, they took Rs 20 lakh along with copy of Aadhaar card, PAN card, land papers and signature on plain paper. Also, the complainant was being threatened by the accused for demanding the money back.

Patna High Court CR. MISC. No.11334 of 2023(3) dt.01-05-2023 2/2 Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case due to village politics. There is no cheat of paper in support of the allegation. The petitioner claims clean antecedent.

Learned counsel for the State and complainant opposes the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate -Ist Class, Patna city in connection with Complaint Case No. 836 of 2021 subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
