The petitioner apprehends his arrest in Rajiv Nagar P.S. Case No. 56 of 2014, registered for the offences punishable under Section 386 and other Sections of the Indian Penal Code. It appears that the petitioner is not named in the FIR. Name of the petitioner figured in the case during the investigation, but the petitioner was not put on test identification parade. Other accused persons has already been enlarged on anticipatory bail by the learned Sessions Judge, but the petitioner filed two anticipatory bail petitions bearing A.B.P. No. 19960 of 2014 and A.B.P. No. 21820 of 2014. In the subsequent anticipatory bail petition the petitioner stated that he has not filed any earlier anticipatory bail petition. Patna High Court Cr.Misc. No.7103 of 2015 (2) dt.20-02-2015 2/2 anticipatory bail petition was rejected by the learned Sessions Judge.

I find that the petitioner on this ground do not deserve anticipatory bail. Accordingly, the same is rejected. The petitioner may surrender in the court below and pray for regular bail and the court below shall consider the prayer for regular bail taking into account that co-accused having same and similar allegation has already been granted bail.
