This application is for grant of bail in connection with S.T. No.264 of 2016 arising out of Dalasing Sarai P.S.Case No.221 of 2012 for the offence under Sections 395/4 of the Indian Penal Code.

It is submitted on behalf of the petitioner that the other coaccused have already been acquitted by the learned court below in Sessions Trial No.197 of 2015 and as the petitioner has no knowledge about this case and he is in custody in connection with other cases, he could not appear at that time and the case of the petitioner is similar to the co-accused and he is in custody for about one year.

Heard learned A.P.P. also.

Patna High Court Cr.Misc. No.8959 of 2017 (2) dt.28-02-2017 2/2 Having heard both sides. From perusal of the of the record, it appears that sessions trial case is going on against the petitioner and the petitioner is named in the F.I.R..

Considering the aforesaid facts, I am not inclined to grant bail to the petitioner at this stage, however, the learned trial court is directed to expedite the trial and try to conclude it within a period of nine months and if not concluded, the petitioner is at liberty to renew his prayer for bail before the learned court below itself.

With the aforesaid observation, this application is dismissed.
