1. Heard learned counsel for the parties concerned.
2. The matter is referred to the State Appellate Authority inasmuch as the writ application has been filed against the order dated 26.08.2016 passed in Appeal Case No. 04 of 2015 by the Presiding Officer, District Appellate Authority, Sitamarhi which has not been challenged before the State Appellate Authority.
3. Regards being had to the nature of dispute, the petitioner is given liberty to file an appeal before the State Appellate
Patna High Court CWJC No.19673 of 2016(2) dt.13-05-2024 2/2 Authority within a period of one month from today.
4. If appeal is filed by the petitioner along with condonation of delay petition, the State Appellate Authority shall consider and dispose the same on its own merit within a reasonable time frame after giving opportunity of hearing to the persons concerned.
5. With the aforesaid observation and direction, this writ application is accordingly disposed.
