2. The petitioner has filed the instant application for grant of regular bail in a case registered for the offences punishable under Sections 394 of the Indian Penal Code.
3. The prosecution case in nutshell is that while the informant along with his father was returning to his home after closing his medical shop, in the meantime, two miscreants came there and one of them snatched golden chain from the neck of his father's neck. When the
Patna High Court CR. MISC. No.10288 of 2025(3) dt.12-05-2025 2/3 informant protested, one of the miscreants fired due to which he sustained gunshot injury on his thigh.
4. It is submitted by learned counsel for the petitioner that the petitioner is innocent and he has falsely been implicated in the present case. Neither the petitioner is named in F.I.R. nor he has been put on T.I.P. Nothing incriminating has been recovered from his possession. The name of petitioner sprang up in this case on confessional statement of co-accused Singku Kumar. After completion of investigation, charge-sheet has been submitted in this case. Moreover, the petitioner is languishing in judicial custody since 14.06.2024.
5. Learned APP appearing for the State has vehemently opposed the prayer for Bail and submitted that petitioner is habitual offender and he has ten criminal antecedents.
6. Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case as well as period of custody, this Court is

The above named petitioner is directed to be enlarged on bail, after framing of charge, in connection with Motihari Town P.S. Case No. 749 of 2023 on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, East Champaran, Motihari, with following conditions:- (i) One of the bailors should be close relative of the petitioner.
(ii) Petitioner shall co-operate in the trial and shall be present on each and every fixed date and on his absence on two consecutive dates without sufficient reason, his bail bonds may be cancelled by the learned trial Court.
