JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 09-11-2016 This application under Section 482 of the Code of Criminal Procedure has been filed for modification of the order dated 24.05.2010 passed in Cr.Misc. No. 44815 of 2009. By the aforesaid order dated 24.05.2010 the petitioner was granted anticipatory bail. While granting anticipatory bail, this Court had directed that in the event of arrest or surrender within a period of one month from the date of communication of the order the petitioner shall be released on bail on furnishing bond and sureties to the satisfaction of the Chief Judicial Magistrate, Nalanda in connection with Complaint Case No. 209C of 2005.
The petitioner failed to appear before the court concerned within the stipulated time. In February, 2015, an
Patna High Court Cr.Misc. No.7074 of 2015 (3) dt.09-11-2016 2/2 application has been filed under Section 482 of the Code of Criminal Procedure for extending the time granted by the Court for furnishing bond in connection with the aforesaid complaint case. No plausible explanation has been given in the application for not complying with the order passed by this Court for over five years.
In that view of the matter, I find no merit in the application. The application is accordingly dismissed. (Ashwani Kumar Singh, J) Pradeep/- U T
