2. The grievance of the petitioner related to discrimination in allotment of funds in developmental scheme with respect to different Panchayats at the block level, as the

Patna High Court CWJC No.3633 of 2023 dt.22-08-2023 2/3 bulk of schemes up to 70 to 80 per cent have been allotted to one particular Panchayat and rest of the Panchayats are left out in the lurch and in the process, the residents of other Panchayats are denied the benefits of developmental works in complete violation of the guidelines issued by the Government from time to time.

3. At the outset, learned counsel for the State submits that for redressal of his grievance, the petitioner has never approached before any authority and, as such, no writ of mandamus can be issued without their being any lawful demand and its refusal by the authority concerned.

Considering the nature of the grievance and submissions made on behalf of the parties, this Court direct the petitioner to approach before the District Magistrate, Rohtas for ventilating his grievance by filing an exhaustive representation bringing on record the entire facts and the guidelines issued by the Panchayati Raj Department.

5. Needless to observe that if such representation is filed within a period of four weeks' from today, the District Magistrate, Rohtas would be under obligation to consider and dispose of the same within a period of eight weeks from the date of filing of such representation along with a copy of this order.

6. With the aforesaid, the writ application stands disposed of.
