The petitioner seeks bail in connection with Kanti (Muzaffarpur) P.S. Case No.328/16 registered under Sections 382, 511, 307, 504, 506/34 of the Indian Penal Code. and Section 27 of the Arms Act.

The accusation is that the informant being the Watch man deputed to watch the campus of K.B.U.N.L., Kanti Plant, identified five persons including the petitioner armed with weapon standing over the wall of the campus for the purpose of committing theft.

Learned counsel for the petitioner submits that the

Patna High Court Cr.Misc. No.13539 of 2017 (2) dt.06-04-2017 2/2 petitioner has falsely been implicated in this case on mere suspicion. Moreover, the petitioner is accused in four cases but he has been acquitted in three cases and he is on bail in one case. He is in jail custody since 20.08.2016. Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000 with two sureties of the like amount each to the satisfaction of the learned S.D.J.M.
