Petitioner seeks bail in a case registered for the offences punishable under Section 30(a)of Bihar Prohibition and Excise (Amendment) Act, 2018.

About 33 liters of foreign liquor was recovered from the motorcycle of the petitioner. Petitioner has got no criminal antecedent. He is in custody since 11.01.2020. Submission is that there is non-compliance of mandate of law in the matter of search and seizure. There is no material to substantiate that petitioner is going to tamper with the evidence or hamper the trial.

Let the petitioner, above named, be released on bail after completion of investigation on furnishing bail bond of

Patna High Court CR. MISC. No.12124 of 2020(2) dt.29-02-2020 2/2 Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Barauli Police Station Case No.09 of 2020, subject to the condition that both bailors shall be resident of territorial jurisdiction of the learned court below and further the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
