1. The petitioner has approached this Court for payment of his remuneration, contemplated in the order of appointment, as directed by the order passed in CWJC No. 2558 of 2014. The aforesaid writ application was disposed of on 26.02.2014, enabling the petitioner to file an appeal before the District Education Officer, Saran.

2. Learned counsel for the petitioner submits that the petitioner was appointed as Night Guard on 31.05.2009, accordingly, he joined the High School, Parshurampur, Amnour, Saran, on 01.06.2009.

3. The petitioner filed a representation before the District Education Officer claiming his remuneration which was disposed on 15.09.2014 by which a direction was issued to School Management Committee for payment of remuneration to the petitioner for the period from 12.06.2009 to 10.11.2011 from the School Development Fund and for the period from 11.11.2011 to 30.11.2013, the direction was to pay the remuneration to the petitioner after realizing it from the then In-charge Headmaster of the School.

Learned counsel for the petitioner submits that the petitioner's payment for the period from 12.06.2009 to 10.11.2011 has already been paid to him, however, payment for the period from 11.11.2011 to 30.11.2013 has not been given to him after realizing the amount from the then In-charge Headmaster.

5. Learned counsel for the State submits that in view of the order passed by the District Education Officer, Saran, necessary direction may be issued to the District Education Officer, Saran, to take steps for payment of remuneration to the petitioner for the period, in question.

6. Having regard to the submissions advanced by learned

Patna High Court CWJC No.19788 of 2016(4) dt.12-09-2024 3/3 counsel for the parties and taking into consideration the impugned order, dated 15.09.2014, the District Education Officer, Saran, is directed to make payment of remuneration to the petitioner for the period 11.11.2011 to 31.11.2013, within a period of three months from the date of receipt/production of this order.

7. The District Education Officer, Saran, shall be at liberty to realize the amount from the then In-charge Headmaster in accordance with law.

8. With the aforesaid observations and directions, this writ application is, accordingly, disposed.
